CANCELLATION & REFUND POLICY

HOW WE MODIFY THIS CANCELLATION & REFUND POLICY

We reserve the right to modify this Cancellation & Refund Policy at any time, and without prior notice, by posting an amended Cancellation & Refund Policy that is always accessible by clicking on the "Cancellation & Refund Policy" link on this site's home page. Your continued use of this site indicates your acceptance of the amended Cancellation & Refund Policy.  

TERMS & CONDITIONS

  1. SERVICES: The Coach agrees to provide coaching Services as described in Exhibit A attached hereto and incorporated herein by reference (the "Services").

  2. TERM: This Agreement shall begin on the Effective Date and shall continue until completion of the Services unless earlier terminated as provided herein.

  3. FEES: In consideration for the provision of the Services by the Coach and the rights granted to the Client under this Agreement, the Client shall pay the Coach the fees set forth in Exhibit A.

  4. CONFIDENTIALITY: The Coach will keep all information exchanged during the coaching sessions confidential unless the Client grants permission to share specific information, or the Coach is required by law to disclose certain information.

  5. CANCELLATION, TERMINATION, AND REFUND: The Client may reschedule a session with at least 24 hours notice. No refunds will be given for missed or canceled sessions with less than 24 hours notice unless otherwise agreed in writing.

  6. TERMINATION AND REFUND POLICY: Please note that any termination must be communicated in writing. Refunds are provided at the discretion of the coach. This refund policy aims to balance the commitment made by both the coach and the client.

    1. Coaching Cycle Packages: These packages are non-refundable once purchased.

    2. Coaching Programs (Non-Action, Compassion Within, Path of Change, Path of Wisdom): Termination must be communicated in writing at least 7 days before the commencement of the first session. The refund of any fees, excluding the non-refundable $500 deposit, will be at the Coach's discretion. After session 1 is completed, no refund will be provided.

    3. Four Seasons Program: Termination must be communicated in writing at least 7 days before the commencement of the first session. The refund of any fees, excluding the non-refundable $500 deposit, will be at the Coach's discretion. After session 1 is completed, no refund will be provided.

 

iv. Termination after session 4 or thereafter: No refund will be provided.

7. RESPONSIBILITIES OF THE CLIENT AND THE COACH

a. Client's Responsibilities:

  1. To attend all scheduled coaching sessions on time.

  2. To come prepared and ready to participate actively in coaching sessions.

  3. To be open and honest during coaching sessions and provide the Coach with all relevant information.

  4. To complete any assignments or tasks set during the coaching sessions.

  5. To communicate promptly with the Coach about any difficulties, questions
    or concerns arising during the course of the coaching relationship.

b. Coach's Responsibilities:

  1. To maintain professional boundaries during the coaching relationship.

  2. To provide a safe and confidential space for the coaching sessions.

  3. Tobepunctualandpreparedforallcoachingsessions.

  4. To communicate with the Client openly, honestly, and without judgment.

  5. To respect the Client's right to terminate the coaching relationship at any
    point.

 

Intellectual Property

8. OWNERSHIP OF INTELLECTUAL PROPERTY: All copyright, trademarks, and other intellectual property rights in and to the materials provided during the coaching sessions, including but not limited to handouts, workbooks, tools, techniques, and methodologies, shall remain the sole and exclusive property of the Coach.

Limitation of Liability

  1. LIMITATION OF LIABILITY: In no event will the Coach be liable to the Client or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the Services, even if the Coach is aware or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the Coach’s liability to the Client for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by the Client to the Coach for the Services during the term of the Agreement.

  2. DISCLAIMER: The Coach makes no guarantees or warranties, express or implied, about any results to be achieved.

 

Dispute Resolution

  1. DISPUTE RESOLUTION: Should any disputes arise from this Agreement, each party commits to seeking resolution through good faith negotiations. If unresolved within 30 days, mediation will be held virtually under the rules set forth by the American Arbitration Association. All costs and fees associated with the mediation shall be shared equally by the parties. Should mediation fail to resolve the dispute within 60 days of initiation, legal proceedings may be initiated in Durango, Colorado, under the jurisdiction of Colorado state law. In such a case, the prevailing party shall be entitled to recover its reasonable attorney fees and court costs from the non-prevailing party.

  2. GOVERNING LAW: This Agreement shall be governed by Colorado state law.

EXHIBIT A

The following details outline the agreed fees and payment schedule for the Services available.

The Client shall indicate their selected payment option, signifying understanding and acceptance of the agreed-upon services.

  1. Coaching Cycle Specific Fees

    1. INTRODUCTORY CYCLE - Payment Due: Payable upfront at the commencement of the cycle.

    2. REGULAR CYCLE - Payment Due: Payable upfront before the start of each cycle.

 

Coaching Program Specific Fees

  1. NON-REFUNDABLE DEPOSIT: To affirm the Client's commitment and reserve their position in the coaching Program, a non-refundable deposit of $500 is required upon signing this Agreement. This deposit will be applied to the total cost of the Program. The deposit is non-refundable if the Client decides to withdraw or cancel their participation in the Program at any time. The intention of this deposit is to account for preliminary administrative and planning expenses, as well as to reserve a space in the Program that might otherwise be filled by other clients. However, if the Coach is unable to provide the coaching Services and withdraws before the start of the Program for any reason, the deposit may be fully refunded to the Client.

  2. PAYMENT DUE: The non-refundable deposit of $500 is due upfront at least 7 days before the start of the first session. The remaining balance can be paid in full or according to an agreed-upon payment plan, with payments due at the beginning of each period (e.g., monthly, quarterly).
